Terms of service
VAI Terms of Service
These Terms of Service apply to services and digital products provided by VAI, including VAI 1:1 Coaching and VAI Programmes.
By purchasing or using a VAI service or digital programme, you agree to the terms that apply to that product or service.
Nothing in these Terms limits your statutory rights under applicable consumer law.
1. VAI 1:1 Coaching
VAI provides personalised online fitness and performance coaching.
Depending on your coaching package, services may include:
- individualised training programming;
- nutrition guidance;
- progress reviews;
- regular check-ins;
- messaging support;
- performance monitoring; and
- ongoing programme adjustments.
The specific services included in your coaching package will be communicated to you before coaching begins.
2. Client responsibilities
You are responsible for providing accurate and relevant information required for your coaching and for keeping VAI informed of changes that may materially affect your ability to train or follow the programme.
You are responsible for carrying out training appropriately, following exercise instructions and using reasonable judgement when undertaking physical activity.
If you experience pain, injury, illness or other symptoms that may affect your ability to train safely, you should stop or modify the relevant activity as appropriate and seek suitable professional advice where necessary.
3. Health and coaching relationship
VAI provides fitness, performance and general nutrition coaching.
VAI coaching does not replace medical diagnosis, medical treatment, physiotherapy, dietetic care or advice from an appropriately qualified healthcare professional.
Where appropriate, you may be asked to obtain medical or other professional clearance before beginning or continuing particular activities.
4. Coaching payments
Coaching fees, payment frequency, the services included and any minimum commitment will be communicated before you enter into a coaching agreement.
Payments must be made according to the agreed payment schedule.
Where coaching continues after an initial minimum commitment, the ongoing payment and cancellation arrangements will be communicated as part of your coaching agreement.
5. Minimum coaching period
Where a minimum coaching period applies, this will be clearly disclosed before purchase or commencement of coaching.
Unless otherwise agreed, VAI 1:1 Coaching is offered with the minimum commitment communicated during the sign-up process.
You remain responsible for payments due during an agreed minimum term, subject to your statutory cancellation rights and the terms of our Cancellation & Refund Policy.
6. Coaching programme adjustments
Individualised training and nutrition recommendations may be adjusted throughout the coaching relationship according to your progress, feedback, performance, recovery, availability, goals and circumstances.
The nature of personalised coaching means that your programme may change over time rather than remaining fixed.
7. Coaching communication
Coaching communication will take place through the platforms and communication methods specified when you join VAI.
Check-in procedures, expected communication methods and other relevant coaching processes will be explained during onboarding.
VAI will use reasonable care and skill in providing its coaching services, as required by UK consumer law.
VAI Programmes
8. Self-guided programmes
VAI may offer self-guided digital training programmes for one-off purchase.
These programmes provide a predetermined training structure for the purchaser to follow independently.
Unless expressly stated otherwise, VAI Programmes do not include:
- individualised programming;
- personalised programme adjustments;
- regular check-ins;
- accountability;
- ongoing direct coaching;
- personalised nutrition coaching; or
- individual performance monitoring.
Purchasing a VAI Programme does not create a VAI 1:1 coaching relationship.
9. Programme information
Before purchasing a programme, you will be provided with information about the programme relevant to your purchase, which may include:
- programme duration;
- training frequency;
- intended goals;
- required equipment;
- intended experience level;
- programme structure;
- what is included; and
- how the programme will be accessed.
You are responsible for considering whether the programme is appropriate for your goals, experience, available equipment and circumstances before purchasing.
Information VAI provides about a service or digital product can form part of the consumer contract, and paid digital content must meet statutory standards including satisfactory quality and matching its description.
10. Programme access
VAI Programmes may be delivered through VAI's website, a training application or another digital platform.
The relevant method of access will be explained before or following purchase.
Where access is provided for a specified period, that access period will be communicated before purchase.
Programme access is provided to the individual purchaser and may not be transferred to another person without VAI's permission.
11. Digital content and cancellation
Where a VAI Programme is supplied as digital content and you request immediate access during the statutory cancellation period, you may be asked to expressly consent to supply beginning immediately and acknowledge that you will lose your statutory right to cancel once supply begins.
UK rules require this consent and acknowledgement before immediate digital supply if the cancellation right is to be lost.
Further information is provided in our Cancellation & Refund Policy.
12. Technical access
You are responsible for having a compatible device, internet connection and any other basic technology reasonably required to access a digital programme.
If you experience an access problem caused by VAI or its programme-delivery arrangements, please contact us so that reasonable steps can be taken to resolve the issue.
Nothing in this section limits statutory rights relating to digital content.
General Terms
13. Results
Individual results vary.
VAI does not guarantee any particular:
- physique or body-composition result;
- amount of muscle gain or fat loss;
- bodyweight;
- strength level;
- running time;
- race performance;
- fitness level; or
- other specific performance outcome.
Results depend on numerous factors including adherence, training history, nutrition, recovery, lifestyle, consistency and individual response.
Nothing in this section affects VAI's obligation to provide services with reasonable care and skill or digital content in accordance with applicable consumer law.
14. Intellectual property and personal use
Training programmes, exercise demonstrations, videos, educational materials, written resources, graphics and other content supplied by VAI remain the intellectual property of VAI or the relevant rights holder unless otherwise stated.
Materials supplied as part of VAI 1:1 Coaching or a VAI Programme are provided for your personal, non-commercial use.
You may not, without prior written permission:
- reproduce or substantially copy programme materials;
- share programme access with another person;
- distribute training plans or resources;
- publish or upload programme materials elsewhere;
- resell programme access or materials; or
- commercially exploit VAI content.
15. Cancellations and refunds
Cancellation and refund arrangements for both VAI 1:1 Coaching and VAI Programmes are set out in our Cancellation & Refund Policy.
Nothing in these Terms excludes or restricts statutory consumer rights that cannot lawfully be excluded or restricted. UK law specifically prevents traders from contracting out of certain statutory digital-content rights.
16. Availability and changes
VAI may update its website, coaching processes, programme-delivery platforms or supporting features from time to time.
Where you have already purchased a service or programme, changes will not remove contractual or statutory rights that apply to your purchase.
Material changes to a purchased service or digital product will be handled in accordance with applicable consumer law and any agreement made with you.
17. Third-party platforms
VAI may use third-party platforms to provide coaching, process payments, communicate with clients or deliver digital programmes.
Your use of those platforms may also be subject to the relevant provider's terms and privacy practices.
VAI remains responsible for its own obligations to you under the contract and applicable consumer law.
18. Changes to these Terms
We may update these Terms from time to time.
The version applicable to a purchase or coaching agreement will generally be the version provided or made available when the relevant contract is entered into, except where subsequent changes are agreed with you or are required by law.
For online sales, relevant contractual information must be provided before purchase and the contract must be confirmed in a form the customer can retain, such as email.
19. Governing law
These Terms are governed by the applicable laws of the United Kingdom, subject to any mandatory consumer protections that apply to you.
Nothing in these Terms affects any rights you may have under applicable consumer law.
20. Contact
If you have questions about these Terms, your coaching agreement or a VAI Programme, please contact us.
